These Terms of Service (“Terms”) govern your purchase and use of the PowerNotify device and related cloud services (“Services”). By ordering or using PowerNotify, you agree to these Terms. "PowerNotify" is a trading name of Dextri LTD, company number 16366332, registered in England and Wales.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and process personal data.
1. The PowerNotify Service
PowerNotify is a device and cloud-based service designed to notify you of potential mains power failures via email, SMS, or phone call. While we aim to provide a reliable service, we cannot guarantee uninterrupted or error-free operation due to dependencies on third-party factors, including but not limited to your Wi-Fi or broadband connection, mobile network operator, and email service provider.
2. Eligibility
You must be at least 18 years old to purchase and use PowerNotify. By using the Service, you confirm that you meet this requirement.
3. Your Responsibilities
- Ensure your PowerNotify device is installed and connected correctly to a suitable Wi-Fi network.
- Maintain up-to-date recipient contact information in the portal.
- Do not misuse the Service, attempt to disrupt it, or use it for unlawful purposes.
4. Orders, Payments & Returns
- Orders placed directly through our website are processed securely via Stripe.
- All prices are shown in GBP and include applicable UK taxes.
- You may return a device within 30 days of purchase in line with our Returns Policy.
- Warranty claims (for faulty devices) are covered for 12 months from purchase.
5. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately if you believe your account has been compromised.
PowerNotify is not responsible for unauthorised access or use of the Service resulting from compromised login credentials.
6. Changes to Pricing and Service Terms
We may update pricing, subscription terms, usage limits, or features of the Service from time to time. Where changes materially affect you, we will provide reasonable notice via the Cloud Portal or email.
Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
7. Service Limitations
You acknowledge and agree that:
- PowerNotify is intended as an aid and should not be relied upon as the sole method of monitoring critical equipment or safety systems.
- Alerts depend on uninterrupted internet connectivity and third-party services. If your broadband or Wi-Fi connection fails while mains power remains on, the Service may generate a false positive outage notification.
- We are not responsible for missed alerts due to factors outside our control (e.g., power outages, internet failures, mobile carrier issues, email account restrictions).
We do not guarantee the delivery time or successful delivery of SMS, email, or call alerts, as these depend on third-party carriers and networks outside our control.
8. Limitation of Liability
To the maximum extent permitted by law, PowerNotify (Dextri LTD) is not liable for any indirect, incidental, or consequential damages arising from the use of the Service. Our total liability for any claim arising out of or relating to the Service is limited, per claim, to the amount paid for the device or the most recent 12 months of credit charges (whichever is greater).
9. Force Majeure
PowerNotify shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond our reasonable control. This includes, but is not limited to, natural disasters, acts of government, power or internet outages, network failures, strikes, or failures of third-party service providers.
10. Credits & Alert Usage
Credit used for SMS and call alerts is non-refundable. You are responsible for configuring alert frequency appropriately and ensuring your device has a stable internet connection. Excessive alert activity caused by user settings (such as very short alert intervals), unstable Wi-Fi or broadband connections, power fluctuations, or other local environmental conditions may result in rapid credit usage.
PowerNotify is not liable for credit consumed due to false positives, repeated power disconnections, or alerts triggered by issues outside our control. All credit usage is final and will not be reimbursed.
11. Fair Use Policy
To maintain a reliable service for all users, PowerNotify operates a fair use policy. Excessive or abnormal alert traffic, device polling, or automated requests that place undue load on our systems may result in temporary throttling or suspension of your account. We will notify you if such action is necessary.
12. Device Updates
PowerNotify devices may receive firmware or software updates from time to time to maintain security and functionality. By using the device, you consent to these updates being applied automatically.
13. Intellectual Property
All trademarks, branding, website content, software, and documentation are the property of PowerNotify. You may not copy, reproduce, or redistribute them without our written permission.
14. Termination
We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or if required by law. You may close your account at any time via the Cloud Portal.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
